Can my husband’s credit card take $$ from my bank acct in TX if he is not on my bank acct? Soldier sued?

tracy h asked:

He is being sued by Assett Acceptance LLC for a debt originally of $7500 from Providian, soldto Washington Mutual and now this Co. They just keep addimg the fees and now a lawsuit. He is deployed, not sure what they can do yet, he has not been served yet. I’ve heard conflicting stories that they don’t even have to noyify him, they filed 6-9-08, but still no word except from an arbitration firm that I believe works for them. Can the garnish for unsecured credit card debt in TX? We don’t own anything free and clear, so what can they do? We quit paying when he was laid off, it was buy gas and food and utilities for our kids or pay them. The creditors will not work with me, they want almost 12,000 now, we can’t afford this now or even when he returns from Iraq with gas prices now. Please any help for a stressed out, stepmom of 2 and foster mom of 3 and worried Armywife would be greatly appreciated.

Unfortunately some credit card companies will resort to filing law suits and even garnish wages in order to be paid. However, you should not give up in trying to get them to reduce the balance to a fraction of the amount they say you owe and offer to pay them a monthly token of a payment (according to what you can afford each month). If you get a hard nosed person on the phone, hang up and call again later until you can find someone willing to work with you.
